SJS Secures Dismissal of Third-Party Lawsuit for Texas Client

On behalf of its client, a Texas company that specializes in chemical blending and toll packaging, Simmons, Jannace & Stagg recently won dismissal of a third-party complaint in an action in which two New York City police officers alleged that they sustained injuries to their lungs when they responded to a chemical spill on a truck.
The chemicals were placed in 55 gallon drums by the chemical blending company who then loaded the drums onto a truck owned by another party to the action. The chemicals were then transported from Texas to New York where the spill was discovered.
The Court dismissed the action against the Texas company on the grounds that it is a nondomicillary corporation that does not "do business" in New York.
